Visa eAccess Terms and Conditions Agreement

The services provided on the Visa eAccess website (the “Service”) are provided so cardholders can access account information online. Cardholders (“you” or “yours”) and any others persons (the “user”) accessing the Visa eAccess website are subject to these terms and conditions for use of the website and the Service.

Access to Service

To use the Service you will need an Internet-ready computer equipped with Microsoft® Internet Explorer (version 6.0 or higher for both Windows® and Macintosh® operating systems). The cardholders are responsible for the installation, maintenance, and operation of your computer or any other Internet Accessible Device. Powerco Federal Credit Union (the “credit union”) is not responsible for any errors or failures from any malfunctions of your computer, and the credit union is not responsible for any computer virus or related problems that may be associated with the use of an online system. Also, your software may include certain functions and features which are not associated with Visa eAccess and the credit union is not responsible for them. You should routinely scan your computer or any other Internet Accessible Devices using a reliable virus detection product. Undetected or unrepaired viruses may corrupt and destroy your programs, files, and even your hardware. Additionally, you may unintentionally transmit the virus to other computers. The credit union shall not be responsible for any computer virus that affects your computer, or software while using the Service. Your browser must also support SSL with 128-bit encryption and be JavaScript ™ enabled. You will be able to access your account information on the Visa eAccess website only if you have signed up for the Visa eAccess service. To ensure successful sign in with the Service, all the information you provide to us must be accurate, complete and current. By submitting the sign in information, you are authorizing us to verify any of the information you provide. Verification of your identity may be achieved through the use of third-party services. You will gain access to the Service through the use of your Internet-Enabled Devices(s), your Internet Service Provider, your User ID and your Password. Cardholders may access the Service 24 hours a day, seven days a week. However, the availability of Service may be suspended for brief periods of time for purposes of maintenance, updating software revisions or emergencies. In addition, access to the Service may be slower at times due to high internet traffic or other factors beyond our control. The credit union is not responsible for any delays or difficulties you may have in accessing the Service or certain features.

The cardholders agree that registration to this Service is conducted only if they have authority to use the card.

Account Information

The credit union determines what information you will be able to access through the Visa eAccess service. Unless you elect to receive your statement online, the account information on the Service is not intended to replace the regular statement you receive by mail or other means. In that case, you must refer to your full credit card statement for complete account information, including important information about your rights and obligations. The Service is not responsible for the accuracy of your statement information or any other issues relating to your account. Any discrepancies or disputes regarding the accuracy of your account summary or details must be addressed directly with the credit union. Copies of previously delivered paper statements must be requested from the credit union. The credit union must maintain a current cardholder e-mail address at all times. It is your sole responsibility to provide the credit union with correct contact information, including e-mail address. The cardholder should notify the credit union of any changes to the personal contact information.

Payment

The cardholder is responsible for ensuring timely payment of all bills and for the method used to make the payments. Any payment service accessed through links from this website is separate from this website and subject to the terms and conditions provided on that website. Visa eAccess is not responsible for problems or issues related to your payments.

The cardholder may electronically schedule payments in any amount not less than $1, or exceeding the current account balance through this Service. Payment frequency is limited to three payments per statement cycle. The cardholder may schedule a payment with Visa eAccess up until 6:00 p.m. EST on a business day to receive credit for the payment on that same business day.

When the cardholder schedules a payment, you authorize the credit union to follow the payment instructions. The credit union may refuse to act on the cardholder’s instruction if sufficient funds, including funds available under any overdraft plan, are not available in the payment account on the transaction date. The credit union reserves the right to refuse to make the payment. The cardholder agrees to pay a return payment fee if the payment is returned for any reason.

You agree not to initiate any payments that are not allowed under the rules and regulations applicable to such accounts including, without limitation, rules or regulations designed to prevent the transfer of funds in violation of OFAC regulations. You agree that the credit union may use any means or routes which in our sole discretion consider suitable to execute the payment including, without limitation: Automated Clearing House transfer (“ACH”), Fedwire transfer (a funds transfer system operated by the Federal Reserve Banks), through Clearing House Interbank Payments System (a funds transfer system operated by The Clearing House); through Society for Worldwide Interbank Financial Telecommunication (SWIFT) or by check. The cardholder agree to be bound by rules and regulations that govern the applicable funds transfer systems including, without limitation, ACH rules as published by the National Automated Clearinghouse Association (“NACHA”).

Payment or Service Cancellation

Once a payment has been submitted it cannot be edited or cancelled.

Security & Privacy

The credit union has taken steps to protect the privacy and security of the cardholder’s personal information as well as financial transactions conducted with the credit union. The cardholder should read the credit union privacy notice before completing the enrollment process for the Service. The cardholder privacy notice is available online at www.powerco.org.

The credit union will only disclose information to third parties about the cardholder account made under the following circumstances:

  1. Where it is necessary for the provision of the Service;
  2. In order to comply with government or court orders, or other reporting requirements;
  3. If the cardholder or user gives the credit union permission;
  4. To credit union affiliated companies;
  5. It is necessary to assist the credit union in the collection of information for internal use;
  6. It is necessary for the security purposes of the credit union service providers, servicing agents, and/or contractors providing this Visa eAccess Service.
  7. It involves a claim by or against the credit union concerning a payment to the cardholder account.

Although the credit union uses stringent security measures and take all reasonable steps to protect the cardholders account and other personal information, the Internet is a public network, and the credit union cannot guarantee that any information transmitted or transactions conducted via the Internet are absolutely secure or that a third party will not be able to access or intercept such payment information.

The credit union does not tolerate fraud, and reserve the right to take all reasonable measures to detect and prevent it. The cardholder is responsible for keeping their User ID and Password confidential. For security purposes, the credit union may view, monitor and record activity on the Service website without notice or permission from the cardholder. Any information obtained by monitoring, viewing, or recording may be subject to review by law-enforcement organizations in connection with investigation or prosecution of possible criminal activity on the Service website. The credit union will also comply with all court orders involving requests for such information. Actual or attempted fraud or other unauthorized use of the Service website and/or Service may result in criminal and/or civil prosecution and immediate termination of the cardholder’s right to use the Service.

Cardholder Conduct

While accessing the Visa eAccess website or otherwise using the Service, you agree not to:

  1. Tamper with, hack, modify or otherwise corrupt the security, content or functionality of the Service;
  2. Restrict or inhibit any other User from using and enjoying the website or the Service;
  3. Post or transmit any information or software that contains a virus, worm, Trojan horse, or other harmful or disruptive component;
  4. Engage in any illegal activity using or in connection with the Service or the website;
  5. Copy, remove or alter any content, intellectual property or copyright, trademark, or other proprietary notice or legend displayed on the website or printed pages from the website;
  6. Give out account information, User ID or Password;
  7. Leave the computer or other Internet Accessible Devices in use unattended while in the Service website;
  8. Allow your internet browser to store User ID and Passwords;
  9. Leave account information within range of others;
  10. Send privileged account information (account number, Passwords, etc.) via any public or general e-mail system;
  11. Allow virus protection to expire or be maintained as required;
  12. Retain existing User ID or Password if lost or stolen. Please use the Password Change feature within the Service website.

If you suspect any fraudulent activity, call the credit union immediately at (404) 506-3750 or toll free (800) 633-5217 between the hours of 9:00 AM to 4:00 PM EST, Monday through Friday. Contacting the credit union is the best way of minimizing your losses and liability.

The credit union reserve the right either to refuse to post, or to remove any information or materials, in whole or in part, that do not comply with these terms. The credit union also reserves the right, in our sole discretion, to prohibit from using the Service website and/or Service any user who violates these terms. Such prohibition may occur without notice to the user.

Term and Termination

This agreement will become effective on the effective date and shall remain in full force and effect until termination in accordance with the following provisions.

  1. The credit union may immediately terminate the Service without notice to you under the following circumstances;

    1. the cardholder does not pay any fee required by this Agreement when due or
    2. the cardholder does not comply with the agreement governing the account(s) or the accounts are not maintained in good standing.

  2. At any time, the credit union may cancel all or part of the Service that is generally offered. Access to the Service may be cancelled in whole or part without prior notice due to returned payments or other circumstances that may create an unanticipated liability to the credit union. If the account is closed or restricted for any reason, access may be terminated. The cardholder will remain responsible for all transactions approved by the Service prior to the cancellation.


  3. If the cardholder wants to terminate this Agreement, you must notify Powerco Federal Credit Union and provide name, address and Service that is to be discontinued, and the termination date of the Service. This notification made by one of the following methods:

  4. The credit union may convert the account to inactive status and suspend access if the cardholder does not sign on to the Service or have any transaction scheduled through the Service during any consecutive 90-day period. The cardholder may reactivate the Service by registering online.

Linked Sites

This Service website may contain links to other websites operated by third parties (“Linked Sites”). Accessing any Linked Site is at the cardholder’s risk. The credit union is not a party to any agreements the cardholder enters with Linked Sites, and is not responsible for the services offered by such sites.

Liability Limitation

Powerco Federal Credit Union will not be liable for any loss resulting from a cause over which the credit union does not have direct control or beyond the credit union’s control, including but not limited to failure of electronic or mechanical equipment or communication lines, power outages, telephone or other interconnect problems, computer viruses, “hacking,” unauthorized access, theft operator errors, delays in the banking system, severe weather, earthquakes, natural disasters, strikes or other labor problems, acts of terrorism, wars, or governmental restrictions, In addition, with the acceptance and use of the Service, you agree that the credit union shall not be liable to the user or any third party or any indirect, incidental, or consequential costs, expenses, or damages (including lost savings or profit, lost data, business interruption, or attorney’s fees) resulting from or arising out of this Agreement or resulting from any errors or failures from any malfunction of the computer and/or Internet Accessible Devices or any virus or device problems that you may encounter related to the use of the Service. The credit union will not be liable to the cardholder in the following instances:

  1. Inability to confirm your identity;
  2. Cardholder inability to access the information on the Service website;
  3. Inaccuracies or errors in the information or material on the Service website;
  4. Termination or suspension of your participation in the Service for security purposes;
  5. The cardholder failure to provide the credit union with correct, current and complete information;
  6. The cardholder failure to notify the credit union immediately, if you believe someone has accessed your account(s) without your permission;
  7. If the credit union has a reasonable basis for believing that unauthorized use of the user Password or account has occurred or may be occurring or if the cardholder default under this Agreement, a credit agreement or any other agreement with the credit union, or if the credit union or cardholder terminate this Agreement;
  8. If the account has been closed;
  9. If the cardholder computer, Internet Accessible Devices, software, telecommunication lines were not working properly or were temporarily unavailable, and this problem should have been apparent to the cardholder when attempted the account access or payment;
  10. If the cardholder had knowledge of or questions about the possible malfunction of the credit union’s system when initiating the transaction;
  11. Other applicable laws and/or regulations exempt the credit union from liability.

The cardholder agree to indemnify, defend and hold the credit union , the affiliated companies, directors, officers, employees and agents harmless against any third party claim, demand, suit, action or other proceeding and any expense related to the Service.

The credit union is not liable for any loss or liability resulting from any failure of the cardholder equipment or software, or that of an Internet Service Provider, by an internet browser or by an online service provider, nor will the credit union be liable for any direct, indirect, special or consequential damages resulting from cardholder access to or failure to access the Service.

The credit union is not responsible for any electronic virus or viruses that the cardholder may encounter. The credit union suggest to you to routinely scan your computer or Internet Accessible Devices using a virus protection product. An undetected virus may corrupt and destroy your programs, files and hardware.

General Terms & Declaimers

THE SERVICE (AND ALL OTHER RELATED SERVICES) IS PROVIDED “AS IS” WITH NO REPRESENTATION OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY OR CONTENT OF INFORMATION, PRODUCTS, SERVICES, OR RESULTS; AND

THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, UNLESS DECLAIMING SUCH WARRANTY IS PROHIBITED BY APPLICABLE LAW.

The credit union reserves the right to change and or discontinue the current provided services at any time, for any reason, to the extent permitted by applicable law.

In addition to this Agreement, the cardholder and the credit union agree to be bound by and comply with the requirements of the agreement applicable to each of the accounts. The cardholder use of the Service is acknowledgment that you have received these agreements and intend to be bound by them.

The credit union may modify the terms and conditions applicable to the service from time to time. The changes may be sent to the cardholder via e-mail and the cardholder will have to be deemed to have received it the day after it is sent. The revised terms and conditions shall be effective at the earliest date allowed by applicable law. If the changes have an adverse effect on the cardholder or the services offered, the credit union will provide the cardholder at least 30 days prior notice. Amendments or changes in terms and/or conditions may be made without prior notice if they do NOT result in higher fees, more restrictive Service use, and disclosure of additional account information to third parties, or increased liability to the user. Also, if a change in terms or conditions is necessary to maintain or restore the security of the credit union system or the cardholder’s account, no advance notice is required. Upon notification of any change in terms, if the cardholder does not agree with the change(s), the cardholder must notify the credit union in writing or via email to cancel the Service. The cardholder continued use of the effected change in the Service constitutes your agreement to the amendment(s).

The credit union may assign this Agreement to an affiliate of the credit union or any successor in interest in the event of a merger, reorganization, change of control, acquisition or sale of all or substantially all assets of the business to which this Agreement is related without the other party’s prior written consent. The cardholder may not assign this Agreement to any other party.

Unless otherwise required by applicable law, any notice or written communication given pursuant to this Agreement may be sent to the cardholder via mail or electronically.

This Agreement is governed by the laws of the State of Georgia and/or the State of Mississippi and applicable federal law.
